Legal
Terms of Service
Effective and last updated: August 24, 2026
Agreement and scope
These Terms govern your use of desireebstephens.com and the offerings provided through it by Make Shi(f)t Happen and Desireé B. Stephens (“we,” “us,” “our”). That includes the public website, the newsletter, the Liberation Education Academy and its courses and resources, memberships and community spaces, digital products, educational and somatic sessions, appointment booking, and speaking, consulting, and school or organizational pathways. By using the site or purchasing an offering, you agree to these Terms.
Nature of the work
The educational, somatic, and community offerings on this site are educational and practice-based. They are not medical care, psychotherapy, diagnosis or treatment of any condition, crisis intervention, legal advice, or any other licensed professional service, and they are not a substitute for care from a licensed provider. Somatic practices are invitational: you choose what to try, you may modify or stop at any time, and you are responsible for deciding what is appropriate for your own body and circumstances. If you are in crisis, contact local emergency services or a crisis line.
Consulting, speaking, and organizational engagements are delivered under the scope described in the applicable proposal, agreement, or invoice, which governs if it conflicts with these Terms.
Accounts and your responsibilities
Some areas require an account. You agree to provide accurate information, keep your credentials confidential, and be responsible for activity under your account. Accounts, memberships, and course access are for a single person and may not be shared, resold, or used to deliver our materials to others. You agree not to interfere with the site, attempt unauthorized access, scrape or bulk-extract content, or use the site in violation of applicable law.
Intellectual property
All content on this site — writing, curriculum, frameworks, recordings, images, and design — is owned by Desireé B. Stephens and Make Shi(f)t Happen or used with permission, and is protected by copyright and trademark law. This includes Liberation is a Lifestyle™, The Liberation Method™, The Liberation Diagnostic™, and the other marks and frameworks identified on the site. Nothing here grants a license to teach, reproduce, adapt, or redistribute these frameworks without written permission.
Digital products and content license
When you purchase a digital product or gain membership access, you receive a limited, personal, non-exclusive, non-transferable license to use the materials for your own learning and practice, including use with your own clients, students, or family where the product is described for that purpose. You may not resell, sublicense, publicly post, share files or logins, or use the materials to build a competing curriculum or training. School and organizational use requires the applicable license offered for that purpose. Physical items, where offered, are subject to the shipping and fulfillment details shown at checkout.
Payment terms
Prices are shown in U.S. dollars and are charged through Stripe. By purchasing, you authorize the charge for the amount displayed at checkout, plus any applicable tax. Recurring memberships and subscriptions renew automatically at the stated interval until cancelled; cancelling stops future charges and access continues through the end of the paid period. Payment plans and installment arrangements, where offered, commit you to the full series of scheduled payments. Digital products and course access are generally non-refundable once delivered, because access is immediate; if something is wrong with what you received, contact us and we will make it right.
Booking, cancellation, and rescheduling
Appointments are offered inside limited weekly windows in U.S. Eastern Time and require a minimum of 48 hours’ notice to book. Availability is deliberately limited; published capacity is a ceiling, not a target.
- 48 or more hours before your start time — you may cancel or reschedule at no charge using the link in your confirmation email.
- Inside 48 hours of your start time — the session is non-refundable, and a missed session is treated as completed. Genuine emergencies happen; exceptions are made at Desireé’s discretion and are not guaranteed.
- If we must reschedule — you will be offered another time or a refund.
Larger engagements and high-ticket exploratory conversations remain email-first and by invitation. There is no public discovery-call calendar; please reach out through the contact page instead.
Community conduct
Community and Academy spaces exist for practice, not performance. You agree to engage with care: no harassment, hate speech, threats, doxxing, or targeted cruelty; no sharing of another participant’s private disclosures outside the space; no unsolicited promotion or recruiting; and no posting of material you do not have the right to share. We may remove content or end participation when conduct puts others at risk or repeatedly disrupts the space.
Third-party services
The site relies on third-party services — including Stripe for payments, Google Calendar for scheduling, Zoom for virtual sessions, and email delivery infrastructure — and links to third-party sites and platforms. Those services are governed by their own terms and policies, and we are not responsible for their content or availability.
Availability and no guarantee of outcomes
We work to keep the site available and accurate, but it is provided on an “as is” and “as available” basis. Features, content, schedules, and pricing may change, and interruptions or errors may occur. We do not guarantee any particular result, healing outcome, income, or institutional change from participating in this work; results depend on many factors outside our control.
Disclaimers and limitation of liability
To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, our total liability arising out of or relating to the site or an offering is limited to the amount you paid us for that offering in the twelve months before the claim, and we are not liable for indirect, incidental, special, consequential, or punitive damages. Nothing in these Terms limits liability that cannot be limited under applicable law. You agree to be responsible for your own choices in applying educational and somatic practices.
Termination and access
You may stop using the site or cancel a membership at any time. We may suspend or end access to an account, community space, or offering if these Terms are violated, if payment fails, or if continued access would put participants or the platform at risk. Where fairness allows, we will tell you why and, for prepaid access ended without cause, refund the unused portion.
Governing law
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules, and the state and federal courts located in Georgia are the venue for disputes, except where applicable law gives you the right to bring a claim elsewhere. We would rather resolve concerns directly first — please write to us.
Changes to these Terms
We may update these Terms as the site and its offerings evolve, and will revise the date above when we do. Continued use after an update means you accept the revised Terms.
